TERMS AND CONDITIONS – KUNSTSTOF FORTE BV

  1. Applicability
    These terms and conditions apply to all offers, orders and agreements entered into by Kunststof Forte BV, whether via the online shop, quotations or direct orders.
  2. Products
    Kunststof Forte BV supplies plastic sheets, pipes, rods, road plates and related materials, either as standard or cut to size according to the customer’s specifications. The customer is responsible for providing the correct dimensions and specifications.
  3. Prices and payment
    All prices include VAT unless otherwise stated. Payment must be made using the payment methods available in the online shop or in accordance with the terms set out in the quotation or invoice. Orders will be processed upon receipt of payment, unless otherwise agreed.
  4. Delivery
    Delivery will be made to the address provided by the customer. We aim to deliver within the specified timeframe, but delivery times are approximate. Exceeding the delivery time does not entitle the customer to compensation.
  5. Bespoke products and the right of withdrawal
    Products that have been specially made or altered to the customer’s specifications are excluded from the right of withdrawal and cannot be returned.
    For standard products, a 14-day right of withdrawal applies from the date of receipt, provided the items are unused and in their original condition. Return costs are payable by the customer.
  6. Warranty and complaints
    Complaints must be reported within a reasonable period of time after discovery via info@kunststofforte.nl.
    A manufacturer’s warranty may apply to HPL exterior panels in accordance with the product specifications. The warranty is void in the event of misuse or incorrect installation.
  7. Liability
    Kunststof Forte BV is liable only for direct damage, up to a maximum of the invoice amount for the product in question. We are not liable for consequential damage, installation errors or the incorrect use of materials.
  8. Retention of title
    All products supplied remain the property of Kunststof Forte BV until full payment has been received.
  9. Privacy
    Personal data is processed in accordance with the applicable data protection legislation (GDPR). Please see our privacy policy for further information.
  10. Disputes and applicable law
    All agreements are governed by Dutch law. Any disputes shall be referred to the competent court in the Netherlands.

ADDITIONAL PROVISIONS FOR CUSTOM-MADE AND TECHNICAL PRODUCTS

Dimensions and specifications
For products that are cut to size or assembled according to the customer’s specifications, the customer is responsible for the accuracy of the dimensions, quantities, thicknesses and other specifications provided. Kunststof Forte BV manufactures and supplies the products based on this information.

Tolerances
Plastic materials may be subject to manufacturing tolerances in terms of dimensions, thickness and squareness. Minor deviations within standard technical tolerances do not constitute a defect.

Colour and texture
Plastic sheets and tubes may show slight variations in colour, gloss or texture compared to images, samples or previous deliveries. This is inherent to the material and does not constitute grounds for rejection.

Application and installation
The customer is responsible for the correct application, processing and installation of the products supplied. Kunststof Forte BV provides advice where possible, but cannot be held liable for any damage resulting from incorrect processing, fixing, construction or use.

Damage caused during transport
Any damage caused in transit must be reported immediately upon delivery and, if visible, noted on the consignment note. Unless reported upon receipt, liability for damage caused in transit cannot be guaranteed.

Check on receipt
The customer must inspect the products for any visible defects or discrepancies immediately upon receipt. Any complaints regarding visible defects must be reported in writing within 48 hours of delivery.

Business orders
In the case of business-to-business (B2B) orders, the statutory right of withdrawal for consumers may not apply.

Digital drawings and files
If the customer supplies drawings, sketches or digital files, these are deemed to be accurate and ready for production. Kunststof Forte BV is not responsible for any errors in the files supplied.
